Gift Card and Client Wallet Policy

Terms governing IVONNE gift cards, client wallet credits, prepaid treatment packages, and cancellation credits — including no-expiry rules under Canadian consumer protection law.

Overview

IVONNE, Inc. ("IVONNE") offers several forms of stored value that clients may use toward treatments and select products. This policy governs the terms and expiry rules for each under Canadian law.

Gift Cards

Issuance and Use

IVONNE gift cards are issued through Square and may be purchased in-clinic or online. Gift cards are redeemable for treatments and select products at IVONNE. Gift cards are not redeemable for cash except where required by law.

No Expiry Date

Gift cards issued by IVONNE do not expire. Under Ontario Regulation 17/05 under the Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A, no expiry date may be applied to a gift card for which monetary consideration was paid. This prohibition applies to all gift cards sold to Ontario consumers.

No Dormancy or Maintenance Fees

IVONNE does not charge dormancy, inactivity, maintenance, or any other fees that would reduce a gift card balance over time. Such fees are prohibited under Ontario Regulation 17/05 and the federal Payment Card Networks Act, S.C. 2010, c. 12.

Lost or Stolen Gift Cards

IVONNE is not responsible for lost, stolen, or damaged gift cards. Clients are encouraged to treat gift cards like cash. Where a card number is known and the balance verifiable, we will make reasonable efforts to assist in recovering the remaining value.

Fees on Purchase

Loading fees may apply at the time of purchase. See our Payment Methods Policy for the full fee schedule applicable to gift card purchases.

Client Wallet Credits

What Is the Client Wallet

The IVONNE client wallet is a prepaid account balance held on a client's profile. Funds are loaded by the client via Interac e-Transfer, credit card, or other accepted payment methods and are used to pay for appointments, treatments, and select products.

No Expiry Date

Client wallet credits funded by the client do not expire. Funds loaded by a client into their wallet remain available indefinitely, consistent with Ontario Regulation 17/05 under the Consumer Protection Act, 2002, which prohibits the imposition of expiry conditions on prepaid consumer value for which monetary consideration was paid.

No Dormancy or Maintenance Fees

IVONNE does not charge, and will not charge, any dormancy, inactivity, maintenance, or administrative fee against a client's wallet balance.

Prepaid Treatment Packages

What Is a Prepaid Package

A prepaid treatment package is a bundle of treatment sessions purchased in advance at a fixed price. Full payment is required before the first session is delivered.

No Expiry on Unused Sessions

Unused sessions within a prepaid package do not expire. Because monetary consideration was paid in full at the time of purchase, the remaining value is protected under Ontario Regulation 17/05 under the Consumer Protection Act, 2002. IVONNE may not impose an expiry date or any fee that reduces the value of unused sessions in a paid package.

Refundability of Packages

Prepaid packages are non-refundable except where required by law. Unused session value remains available on the client's account indefinitely. Where a client is unable to continue treatment, unused value may be applied toward alternative treatments or transferred to another person via a IVONNE gift card, subject to the recipient meeting IVONNE's eligibility requirements for services. Credits Held on File from Cancelled Appointments

Under the IVONNE Cancellation Policy, cancellation fees, no-show fees, and late arrival fees are charged to the client and are forfeited as a loss — they are not automatically held as credits. The client agrees to this at the time of booking.

However, at its sole discretion, IVONNE may elect to hold some or all of those funds as a credit on a client's account for future use rather than retaining them as revenue. This is a business courtesy, not an entitlement.

When IVONNE makes this election, the held credit does not expire and is not subject to dormancy fees. The moment funds are designated as a client credit rather than forfeited revenue, Ontario Regulation 17/05 under the Consumer Protection Act, 2002 applies — prohibiting any expiry date or fee that would reduce the value of those funds.

Whether to hold funds as a credit is determined case by case and is not guaranteed regardless of the reason for cancellation.

Promotional Credits

Credits issued by IVONNE as a promotional benefit, courtesy adjustment, referral reward, or goodwill credit — that is, credits not purchased by the client — may carry an expiry date or conditions, as these do not constitute monetary consideration paid by the client and are therefore not subject to the expiry prohibitions under Ontario Regulation 17/05. Any such conditions will be disclosed at the time the promotional credit is issued.

Service Eligibility for Gift Card Recipients

The holder of a gift card or transferred credit must independently satisfy IVONNE's service eligibility requirements before any services may be rendered. A gift card entitles the holder to redeem its value against eligible services — it does not guarantee access to any specific treatment.

Eligibility to receive services, treatments, or products from IVONNE is subject to the following requirements, all of which must be satisfied at the time of each appointment or purchase:

  1. Consultation and Assessment
    A prospective client must have received a consultation or cost estimate from a IVONNE provider and been specifically recommended for the treatment, package, or product in question. Self-assessment does not satisfy this requirement. Those who have received a consultation are eligible to purchase and use products available through IVONNE, its website shop.ivonne.ca, or alumiermd.com.
  2. Absence of Contraindications
    The client must not present with any active contraindications to the scheduled treatment or product as identified in IVONNE's Contraindications Policy and intake assessment. Contraindications include but are not limited to: active skin conditions, certain medications, pregnancy or breastfeeding, recent procedures, sun exposure or sunburn, and any medical condition that a provider determines makes the treatment unsuitable or unsafe.
  3. Patch Test Compliance
    Where a patch or sensitivity test is required under the Patch & Sensitivity Test Policy, the client must have completed the required test with a satisfactory result within the applicable timeframe prior to the scheduled treatment.
  4. Product Usage
    Clients agree to only use products for which they have received a consultation or recommendation, and in accordance with the instructions provided by IVONNE or the manufacturer. This includes any samples provided. Clients agree not to use any product either by itself or in combination for any other purpose, including off-label uses.
  5. Policy and Terms Compliance
    The client must be in good standing with all IVONNE policies and the Service Agreement, including the Cancellation Policy, Scheduling Policy, and Payment Methods Policy. Clients with outstanding balances, repeated no-shows, recurring late arrivals, or repeated cancellation and rescheduling activity constituting an abuse of schedule will be restricted from appointments at IVONNE's discretion.
  6. Age and Informed Consent
    The client must be of legal age to consent to the service in the Province of Ontario (18 years of age), or have a parent or legal guardian provide documented consent where applicable. Clients must have completed all required intake and informed consent documentation prior to their appointment.
  7. No Conflict of Interest
    Contacts where IVONNE determines that a conflict of interest exists or is likely to exist are not eligible to receive services. Contacts with online reviews of any business that are seen as abusive, made without any intention of resolution, or with a history of primarily poor reviews only, may be prevented from using services and products at IVONNE.
  8. Provider Determination and Right to Refuse
    Final eligibility for any service is determined at the sole and absolute discretion of the IVONNE provider at the time of the appointment. A client who presents as eligible at the time of booking may be found ineligible at the appointment if their circumstances have changed. IVONNE reserves the right to refuse service at any time and for any reason consistent with applicable law, including the Ontario Human Rights Code, R.S.O. 1990, c. H.19.

Alternative Treatment for Ineligibility

Clients who check in for an appointment but are deemed ineligible for their scheduled treatment due to sun exposure, sun tan, or sunburn will receive an alternative treatment to supplement and replace the ineligible treatment. The default alternative treatment is a Hydrafacial, and clients will be charged at the regular price for the performed treatment.

Eligibility requirements apply equally to recipients of transferred gift card value or wallet credits. The holder of a gift card or transferred credit must independently satisfy all of the above requirements before services may be rendered.

Account Closure

In the event a client account is closed, any remaining client-funded wallet balance, unused package sessions, or credits held on file will be offered as a gift card or, where required by law, refunded to the client's original payment method.

Applicable Canadian Legislation

  • Consumer Protection Act, 2002, S.O. 2002, c. 30, Sched. A (Ontario) — prohibits expiry dates and fees on prepaid consumer value where monetary consideration was paid.
  • Ontario Regulation 17/05 (under the Consumer Protection Act, 2002) — gift cards and prepaid funds must not have an expiry date or be subject to any fee that reduces their value, including dormancy fees.
  • Payment Card Networks Act, S.C. 2010, c. 12 — federal framework governing payment card networks and prepaid payment products; reinforces provincial no-expiry and no-fee requirements.

Where provincial and federal laws differ, the standard most protective of the consumer applies.
